Terms of Service

By downloading or using ChromaCal, you agree to these Terms of Service. Please read them carefully. If you do not agree, please do not use the app.

These Terms apply to your use of ChromaCal across all platforms and distribution channels where it is made available. Platform-specific terms in Section 16 supplement these Terms for users who obtained ChromaCal from the indicated platform.

1. About ChromaCal

ChromaCal is a color-coded calendar application for iPhone and iPad that lets you tag events with custom event types and visualize your year as a color heatmap. These Terms govern your use of the ChromaCal app and any related services or websites operated by us.

"ChromaCal," "we," "us," or "our" refers to Vibe2Viable LLC, the developer and operator of the ChromaCal application. "You" refers to the individual using the app.

2. Acceptance of Terms

By downloading, installing, or using ChromaCal, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you are under 18, you may use ChromaCal only with the consent of a parent or guardian who agrees to these Terms on your behalf.

3. Subscriptions and Payment

3.1 Subscription Plan

ChromaCal is offered via an auto-renewable subscription that unlocks the full app experience, including the heatmap calendar, color-coded event types, year view, widgets, iCloud sync, and JSON export & import. Current pricing:

  • ChromaCal Annual: $1.99/year (with a 7-day free trial for new subscribers)

Pricing may change. See Section 3.5 for details.

3.2 Free Trial

New subscribers may be eligible for a 7-day free trial. If you do not cancel at least 24 hours before the end of the trial, your subscription will automatically begin and you will be charged the standard annual price ($1.99/year). Free trial eligibility is determined by Apple.

3.3 Payment Processing

All purchases and subscription payments are processed entirely through the Apple App Store via StoreKit 2. We do not collect, handle, or store your payment information in any form. Your purchase is subject to Apple's terms and conditions: apple.com/legal/internet-services/itunes/.

3.4 Auto-Renewal

The annual subscription automatically renews at the end of each yearly billing period unless you cancel at least 24 hours before the renewal date. You will be charged through your Apple ID account.

To cancel your subscription: open iOS Settings → tap your name → Subscriptions → select ChromaCal → Cancel Subscription.

Important: Deleting the ChromaCal app from your device does not automatically cancel your subscription. You must cancel through iOS Settings as described above to stop future charges.

3.5 Refunds

All refund requests are handled by Apple in accordance with their App Store refund policy. To request a refund, visit reportaproblem.apple.com. We do not have the ability to issue refunds directly.

3.6 Price Changes

We may change subscription prices from time to time. Apple will notify you before any price change takes effect. If you do not agree with the new price, you may cancel before the next renewal.

4. Use of the App

4.1 License

We grant you a limited, non-exclusive, non-transferable, revocable license to use ChromaCal on Apple devices you own or control, for personal, non-commercial purposes, in accordance with these Terms.

4.2 Prohibited Uses

You agree not to:

  • Copy, modify, distribute, sell, or sublicense any part of the app
  • Reverse engineer, decompile, or disassemble the app
  • Use the app for any unlawful or unauthorized purpose
  • Remove or alter any copyright, trademark, or proprietary notices
  • Attempt to circumvent subscription requirements or access restrictions
  • Use automated means to access or interact with the app

4.3 Eligibility

ChromaCal is available on the App Store for users in supported regions. You must comply with all applicable laws in your jurisdiction when using the app.

5. Your Content

5.1 Ownership

You retain full ownership of all calendar data, events, event types, colors, notes, and other content you create within ChromaCal ("Your Content"). We claim no ownership over Your Content.

5.2 Storage and Sync

Your Content is stored locally on your device. If you enable iCloud sync, Your Content is also synchronized through your own private CloudKit database under your Apple ID. We do not store, access, or process Your Content on our own servers.

5.3 Export

ChromaCal lets you export Your Content to a portable JSON file at any time. The exported file is yours to keep, share, archive, or move to another device.

5.4 App Content

All interface elements, design, default color palettes, and other original content comprising the ChromaCal app itself are owned by Vibe2Viable LLC and protected by copyright and intellectual property laws. You may not reproduce or redistribute the app or its proprietary materials without our permission.

6. Data and Privacy

ChromaCal stores your calendar data locally on your device, with optional sync via Apple iCloud (CloudKit). We do not collect personal data on our servers and we operate no servers that touch Your Content.

7. Disclaimer of Warranties

CHROMACAL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The app will be uninterrupted, error-free, or free from bugs
  • iCloud sync will be free of latency, conflicts, or temporary outages
  • The app will be compatible with all devices or operating system versions
  • Any defects will be corrected

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VIBE2VIABLE LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data or app content (including loss caused by iCloud sync conflicts or device resets)
  • Loss of access during service interruptions or app updates
  • Damages arising from reliance on the app for scheduling, planning, or memory of events

You are solely responsible for maintaining your own backups (such as via JSON export) of any data you consider important. Vibe2Viable LLC's total liability to you for any claim arising out of these Terms or your use of ChromaCal shall not exceed the amount you paid for your subscription in the twelve (12) months preceding the claim, or $10, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless Vibe2Viable LLC and its developers from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the app.

10. Third-Party Services

ChromaCal relies on Apple platform services — including the App Store, StoreKit, and iCloud (CloudKit) — to operate. Your use of these services is governed by Apple's terms and conditions. Apple is not a party to these Terms and has no obligation to provide support or maintenance for ChromaCal.

We may link to or reference third-party websites in app documentation or this site. We are not responsible for the content, privacy practices, or terms of any third-party services.

11. Termination

We reserve the right to discontinue ChromaCal or remove it from the App Store at any time, with or without notice. If the app is discontinued, your subscription (if active) will be managed through Apple's standard refund policies.

You may stop using ChromaCal at any time by deleting it from your device and cancelling any active subscription through the App Store.

12. Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including, without limitation, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, epidemics, strikes, shortages of transportation, fuel, energy, labor, or materials, failure of third-party services (including Apple's App Store, StoreKit, or iCloud), or interruptions to the internet or telecommunications infrastructure.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be noted in App Store release notes and on this page. The "Last Updated" date at the top of this page reflects when the Terms were most recently revised.

Your continued use of ChromaCal after changes are posted constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of ChromaCal shall be resolved in the state or federal courts located in Virginia.

ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU AND VIBE2VIABLE LLC AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.

16. Platform-Specific Terms

The following platform-specific terms apply based on where you obtained ChromaCal. They supplement the preceding sections of these Terms. In the event of any conflict between a platform-specific term in this section and a preceding section, the platform-specific term controls for users who acquired ChromaCal through that platform.

16.1 Apple App Store (iOS, iPadOS, macOS)

If you obtained ChromaCal through the Apple App Store, the following terms apply between you and Vibe2Viable LLC, and not between you and Apple Inc. ("Apple").

16.1.1 Acknowledgment

These Terms are concluded between you and Vibe2Viable LLC only, and not with Apple. Apple is not responsible for ChromaCal or its content. To the extent these Terms provide for usage rules for ChromaCal that are less restrictive than, or conflict with, the Apple Media Services Terms and Conditions, the more restrictive or conflicting Apple term applies.

16.1.2 Scope of License

The license granted to you for ChromaCal in Section 4.1 is further limited to a non-transferable license to use ChromaCal on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. The license also permits you to access ChromaCal through Apple Family Sharing, subject to Apple's rules for Family Sharing.

16.1.3 Maintenance and Support

Vibe2Viable LLC is solely responsible for providing any maintenance and support services with respect to ChromaCal, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to ChromaCal.

16.1.4 Warranty

Vibe2Viable LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed in these Terms. In the event of any failure of ChromaCal to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) you paid for ChromaCal through the App Store. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to ChromaCal, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Vibe2Viable LLC's sole responsibility.

16.1.5 Product Claims

Vibe2Viable LLC, not Apple, is responsible for addressing any claims you or any third party may have relating to ChromaCal or your possession and use of it, including but not limited to: (i) product liability claims; (ii) any claim that ChromaCal fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

16.1.6 Intellectual Property Rights

In the event of any third-party claim that ChromaCal or your possession and use of ChromaCal infringes that third party's intellectual property rights, Vibe2Viable LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

16.1.7 Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

16.1.8 Third-Party Beneficiary

You and Vibe2Viable LLC acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms as they apply to your license to ChromaCal, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
